These terms are an agreement between you and Gabriel Trzimajewski (“we”), who runs Splitty from Brazil. By creating an account or using the app, you accept them. If you don’t, don’t use Splitty.
What Splitty is
Splitty helps groups of people record shared expenses, see who owes whom and record payments between them. It is a record-keeping tool:
- Splitty doesn’t move money. It doesn’t process, hold or transfer funds. When you “settle up”, you are recording a payment you made some other way.
- Splitty doesn’t check amounts. Balances are calculated from what group members enter. We can’t guarantee that what someone entered is true or correct.
- Splitty isn’t financial, tax or legal advice. Don’t rely on it as an accounting record for tax or legal purposes.
Your account
You need to be at least 13 years old to use Splitty. If you are under 18, you need permission from a parent or guardian, who accepts these terms for you.
You sign in with a third-party account, such as Google. Keep that account secure: anything done through your Splitty account is your responsibility. Tell us at support@splitty.app if you think someone else has accessed it.
Groups and shared content
Groups work on trust. Every member of a group can see its members’ names, email addresses and photos, and can add, edit and delete any expense or payment in it. Invite only people you trust, and join only groups you trust. We don’t take part in disagreements between members about what is owed.
You keep ownership of what you add to Splitty. You give us permission to store it, process it and show it to the members of the groups you share it with, only as needed to run the service. That permission ends when the content is deleted, except that expenses already shared with a group stay visible to it after you delete your account, as described in the Privacy Policy.
Acceptable use
Don’t use Splitty to:
- break the law, or record or organize illegal activity;
- harass, threaten or deceive other people;
- upload images you have no right to use, or that are offensive or sexual;
- guess invite codes, overload the service, get around its limits or access data that isn’t yours;
- copy, resell or reverse engineer the service, except where the law allows it.
We may suspend or close accounts that break these rules. Where reasonable, we will tell you why first and give you a chance to respond.
Price
Splitty is free. If we ever introduce paid features, we will tell you before anything is charged, and you will choose whether to pay.
Changes to the service
We are improving Splitty all the time and may add, change or remove features. If we decide to shut Splitty down, we will announce it in the app at least 30 days before, so you can export your groups’ expenses.
Ending your account
You can deactivate or delete your account at any time in Settings. What happens to your data is explained in the Privacy Policy.
Liability
We provide Splitty as it is and as available. We work to keep it accurate and running, but we can’t promise it will be free of errors or interruptions, or that balances calculated from what members entered are correct.
To the extent the law allows, we aren’t liable for indirect losses, or for losses caused by what other users entered, by payments made or not made between members, or by events outside our reasonable control.
Nothing in these terms limits rights you have as a consumer that can’t be waived, including under Brazil’s Consumer Defense Code (Law 8.078/1990), or limits liability for fraud or gross negligence.
The App Store
If you got Splitty from Apple’s App Store:
- These terms are between you and us, not Apple. Apple isn’t responsible for Splitty or its content.
- Apple has no obligation to provide maintenance or support for Splitty.
- If Splitty fails to meet a warranty that applies, you may notify Apple, and Apple will refund the price you paid, if any. Apple has no other warranty obligation for Splitty.
- Apple isn’t responsible for claims about Splitty, such as product liability, legal compliance, consumer protection or privacy claims, or claims that Splitty infringes someone’s intellectual property. We are responsible for handling those.
- You confirm that you aren’t in a country under a U.S. Government embargo or listed as a terrorist-supporting country, and that you aren’t on a U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Apple’s Licensed Application End User License Agreement also applies to your use of the app, where it doesn’t conflict with these terms.
Law and disputes
These terms are governed by the laws of Brazil. If you are a consumer, you can bring a claim in the courts where you live. Before going to court, write to support@splitty.app: most problems can be sorted out directly.
Changes to these terms
If we change these terms, we will update the date at the top. For changes that matter, we will tell you in the app at least 15 days before they take effect. If you keep using Splitty after that, you accept the new terms. If you don’t, you can delete your account.
